Terms of Service

These Terms of Service govern your access to and use of the SmarterSingers, operated by Old Capitol Chorus of Iowa City, a not-for-profit organization. By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

The SmarterSingers is a web-based tool that accepts uploaded audio recordings of singing performances and provides AI-generated coaching feedback across categories including pitch and tone, stylistic expression, word accuracy, and rhythm. The Service also supports human coaching input from Directors and Section Leaders, progress tracking, and contest score logging.

2. Eligibility

The Service is open to members and participants of Barbershop Harmony Society affiliated choruses and quartets. Users under the age of 13 must have verifiable parental consent. By using the Service, you represent that you are either 13 years of age or older, or that you have obtained appropriate parental or guardian consent.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Administrators may create accounts on behalf of chorus members using temporary passwords. It is the member's responsibility to change their password upon first login.

Account Deactivation
You may deactivate your own account at any time via your Profile page. Deactivation prevents further login but does not delete your data — your recordings, analyses, and scores remain in our systems unless you separately request permanent deletion in writing to our Admin, as described in our Privacy Policy.

4. User Content

Your Recordings
You retain ownership of any audio recordings you upload to the Service. By uploading a recording, you grant Old Capitol Chorus of Iowa City a limited, non-exclusive license to store, process, and transmit the recording solely for the purpose of generating coaching feedback and displaying results to you and your authorized chorus leadership.

Music Licensing
You are solely responsible for ensuring that any musical content in your recordings is used in compliance with applicable copyright law. The Service is intended for personal coaching and practice purposes only — not for distribution, public performance, or reproduction of copyrighted works. Old Capitol Chorus of Iowa City expressly disclaims any responsibility for copyright infringement arising from content you upload.

Prohibited Content
You agree not to upload recordings or content that is unlawful, defamatory, harassing, or that violates the rights of any third party.

5. AI-Generated Feedback

Coaching feedback generated by the Service is produced by an artificial intelligence model (Anthropic Claude) and is intended solely as a practice and development aid. It does not constitute official BHS adjudication and should not be treated as such. Scores and feedback reflect the AI's analysis of audio content and may not perfectly reflect the judgment of a certified BHS judge.

We make no warranty that AI-generated feedback is accurate, complete, or suitable for any particular purpose. Use of AI feedback is at your own discretion.

6. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Subscriptions and Payment

Certain features of the Service may require a paid subscription. Subscription fees, billing cycles, and plan details will be displayed at the time of purchase. All payments are processed by Stripe, Inc. You agree to Stripe's Terms of Service in addition to these Terms.

Old Capitol Chorus of Iowa City reserves the right to change subscription pricing with reasonable advance notice to current subscribers. Refunds are issued at our discretion and in accordance with applicable Iowa consumer protection law.

As a not-for-profit organization, we strive to keep the Service affordable for all chorus members. Hardship accommodations may be available — contact us to inquire.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Attempt to gain unauthorized access to other users' accounts or data
  • Upload malicious code or attempt to disrupt the Service
  • Reverse-engineer or attempt to extract the source code of the Service
  • Use the Service in any way that could harm Old Capitol Chorus of Iowa City or other users
  • Misrepresent your identity or chorus affiliation

9. Intellectual Property

The SmarterSingers software, design, and AI prompting system are the intellectual property of Old Capitol Chorus of Iowa City. Nothing in these Terms grants you any right to copy, reproduce, distribute, or create derivative works from the Service.

The Barbershop Harmony Society name and associated marks are the property of the Barbershop Harmony Society. Old Capitol Chorus of Iowa City is an affiliated chapter and uses these marks with permission. The Service is not officially endorsed by or affiliated with the Barbershop Harmony Society at the international level.

10. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. Old Capitol Chorus of Iowa City disclaims all warranties including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by Iowa law, Old Capitol Chorus of Iowa City and its officers, directors, members, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or personal injury, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Old Capitol Chorus of Iowa City and its officers, directors, members, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any copyright, trademark, or privacy right; or (d) any content you upload to the Service.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Johnson County, Iowa, and you consent to the personal jurisdiction of such courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use of the Service following notice of changes constitutes your acceptance of the revised Terms.
